Covered Provider

Definition

Per Section 22757.1(b), a "covered provider" means a person that creates, codes, or otherwise produces a generative artificial intelligence system that has over 1,000,000 monthly visitors or users and is publicly accessible within the geographic boundaries of the state.

Key Criteria

1. Creation Role: Must create, code, or produce a generative-ai system
2. Scale Threshold: System must have over 1 million monthly visitors or users
3. Public Access: System must be publicly accessible
4. Geographic Scope: Must be accessible within California's boundaries

Obligations

Covered providers must:

• Provide free ai-detection-tools
• Offer manifest-disclosure options to users
• Include latent-disclosures in all AI-generated content
• Maintain licensing compliance for third-party deployments
• Collect and incorporate user feedback on detection tool efficacy

Privacy Protections

Covered providers are prohibited from:

• Collecting or retaining personal information from detection tool users (except opt-in contact information for feedback)
• Retaining submitted content longer than necessary
• Retaining personal provenance data from user submissions
